Unlimited Data – Terms and Conditions

Unlimited Data Plans refer to unlimited “permitted use”. Permitted Use, as used here, means ordinary-course-of-broadcasting use, made in accordance with the (i) customer’s purchase order, including the covered event(s), date(s), and territory(ies); and (ii) LiveU Terms and Conditions, LiveU documentation, and general practices of LiveU customers and industry standards. LiveU pricing is based on permitted use. LiveU uses a baseline of 200 GB per month/per field unit (e.g. LU 300, 600, 800) as a standard for permitted use calculation based on a pooling of all LU units that the customer has under the same rental program. LiveU refers to this as a Fair Use Policy for Unlimited Data Plans. LAN/WIFI usage does not count toward the average permitted use calculation. LiveU limits the broadcast rates of some products and services, in the ordinary course of business, and these broadcast rate limits are not affected by the data plan(s) purchased by customer, including when customer purchases an Unlimited Data Plan. If a customer exceeds the Fair Use Policy for Unlimited Data Plans, LiveU will issue a warning notice to the customer. If, after a warning has been issued to the customer, the customer again exceeds the Fair Use Policy for Unlimited Data Plans, LiveU may decrease the broadcast rate or performance of the data and/or require the customer to purchase additional data services. If the parties cannot reach agreement about continued use, LiveU may, at its discretion, suspend or terminate the Unlimited Data Plan and require the customer to change to a limited data plan or terminate the purchase order and/or associated Agreement. If the customer has one or more existing agreements with LiveU for data plans, then those agreements will continue to apply to those plans and are separate from the Unlimited Data Plans covered by this section.
